be a substantial disadvantage to Ms. Copman to have Mr. Woodell disqualified. Whereas I dont <br />think theres any disadvantage to the applicant to have Mr. Woodell here because theyre ably <br />represented by Mr. Vitousek. I also would not want to see him disqualified because it would <br />mean you would have to continue the matter until Ms. Copman could get somebody else to <br />represent her and I dont think that thats in the best interest of any of the parties here. As to the <br />merits of the issue I think that thats something that should probably be taken up by the <br />disciplinary Counsel. For this board to get into that issue I think is a distraction and gets away <br />from what the real issue is as whether the permit should be granted or not. <br />GALDONES:Commissioners any questions of Ms. Leithead-Todd? So unless one of the parties has some other <br />authority otherwise it seems to me that under the rules it would be something that the chairperson <br />would make a decision on. Of course youre welcome to give the chairperson your input on that. <br />Mr. Chair if I may ask Mr. Woodell something really briefly? I just want to clarify something. <br />Mr. Woodell you stated that youre, youre not actively practicing law at this point? <br />WOODELL:Thats correct. <br />TORIGOE:Okay. But are you licensed to practice law in the State of Hawaii at this <br />point? <br />WOODELL:Yes Im licensed to practice law in the State of Hawaii. <br />TORIGOE:Thank you. <br />GALDONES:Commissioners having heard counsels remarks do we have any <br />comments before the chair makes a ruling? Commissioner Springer? <br />SPRINGER:I appreciate the remarks of Ms. Leithead-Todd and I would concur with <br />them. <br />GALDONES:Thank you. Seeing no further discussion or no further questions from the <br />commissioners the Chair ruling on the motion to disqualify Allen W.
