Are there any other commentsthat youd like to make regarding <br />the substance of the allegations at this point? <br />GALDONES:Well for one thing as a Commissioner and also as the chair of this <br />commission I do not like to see something like this occurring because it prejudices the clients <br />work and all that goes into this case so the only thing that I-. Im not the disciplinarian or <br />anything but Mr. Woodell having gone through this exercise that you have seen before us I <br />would appreciate it if you would refrain from conducting yourself in this manner in the future. <br />Thank you. Commissioners, we are now dealing with the hearings officers report. <br />HAYASHI:Mr. Chair? Before we proceed I just wanted to clear the record on the <br />questionthatCommissionerSiracusaaskedregardingtheenrollmentfigure.Okayasfarasthe <br />applicant initially submitted a, when they submitted the application indicated that would be a <br />maximum of 75 students grades K to 5. However at the hearing, contested case hearing when <br />Mr. Woodell questioned Dr. Sturges who is a member of the, I mean who is the, with Parker <br />School, his response was that there would be a maximum of 90 students. And that is why the <br />hearings officers reflected that under her item 36. Just for your information our, excuse me, the <br />Planning Directors recommendation was to have a maximum of 120 students and the reason for <br />that I believe was that, that was similar to another case or that was granted by the Planning <br />Commission with a maximum 120 students K to 5. <br />GALDONES:Thank you Norman. Commissioner Springer? <br />SPRINGER:Norman could you tell us the page and line that that appears on in the <br />transcript? <br />GALDONES: The transcript would be page 61 and that would be in the middle section <br />where Mr. Woodell questioned Dr. Sturges. <br />SPRINGER:Got it thank you. <br />HAYASHI:One other thing too, I must note that the Planning Directors and I believe <br />this might have not been corrected but the Planning Directors recommendation the last portion <br />states that the Planning Director may initiate rezoning and that was incorrect. It should have <br />been initiate (inaudible) procedures for the nullification or verification of the permit. <br />GALDONES:Procedurally commissioners and also for the parties before us. What we <br />will be doing is addressing the hearings officers Findings of Facts and Conclusions, allow the <br />parties to address that, give you folks an opportunity to question. And after that there have been, <br />there are people from the public who have signed up to testify then I will be taking testimony <br />from the public thereafter. Then we will be going into decision making okay? Commissioners <br />hearings officers proposed Findings of Fact, Conclusions of Law and Recommendations of the <br />Hearing Officer.
