12. October 26, 1998: Effective date of an amendment to SPP 549, to allow an increase in <br />the maximum enrollment from 120 to 180 students. <br />13. April 9, 2009: Final Subdivision Approval granted for Subdivision No. 09-000878, to <br />subdivide Parcel 37, thereby creating Lot 4-A (5.002 acres) and Lot 4-B (3,713 square feet) <br />and designating Drainage Easement "A" (200 square feet). Lot -4-B was intended to <br />provide a 10 -foot -wide addition to the Palani Road Right -of -Way, however it still needs to <br />be dedicated to the County and recorded with the Bureau of Conveyances. July 24, 2009: Permit to Work Within the County Right -Of -Way issued by DPW, for <br />Palani Road widening and construction of turn lane, installation of water line, water meter <br />and service lateral. (Planning Department Exhibit 3 — DPW Permit dated July 24, <br />2009) <br />15. July 20, 2011: Final Subdivision Approval granted for Subdivision No. 10-000981, to <br />subdivide Parcel 38 into 4 lots, including Parcel 46 and Lot 5-A-2, a roadway -widening <br />lot. Change of Zone Ordinance 98-8 included a requirement that in conjunction with Final <br />Subdivision Approval, a roadway section fronting Parcel 46 along Palani Road shall <br />provide for the future road widening of Palani Road to an 80 -foot -wide right-of-way and <br />shall be subdivided and dedicated to the County upon its completion. As such, Lot 5-A-2 <br />still needs to be dedicated to the County and recorded with the Bureau of Conveyances. <br />(Planning Department Exhibit 4 — SUB 10 -000981 -Revised dated July 20, 2011) <br />STATE & COUNTY PLANS <br />16. State Land Use District: Parcel 37 is designated Agricultural and Parcel 46 is <br />designated Rural. <br />17. General Plan Land Use Pattern Allocation (LUPAG) Map: The General Plan LUPAG <br />map classifies both subject properties as urban expansion (UE). The UE designation allows <br />for a mix of high density, medium density, low density, industrial, industrial -commercial <br />and/or open designations in areas where new settlements may be desirable, but where the <br />specific settlement pattern and mix of uses have not yet been determined. <br />18. County Zoning: Parcel 37 is zoned Agricultural -5 acres (A -5a) and Parcel 46 is zoned <br />Residential -Agricultural -.5 acres (RA -.5a). <br />-3- <br />
