action. The applicant's environmental consultant will be sending a letter to the State <br /> DLNR Historic Preservation Division requesting a concurrence of"no effect". <br /> F. Cultural and Historic Resources: <br /> No valued cultural, historical or natural resources exist on the subject property and no <br /> gathering is taking place. To the extent to which traditional and customary native <br /> Hawaiian rights are exercised, the proposed action will not affect traditional Hawaiian <br /> rights;therefore no action is necessary to protect those rights. <br /> G. Drainage: <br /> According to the U.S. Corps of Engineer Flood Insurance Rate Map (FIRM),the subject <br /> site is designated"X", an area outside of the 500-year flood plain. <br /> SECTION 9-RATIONALE FOR THE ISSUANCE OF A USE PERMIT <br /> The Project is a permissible use that complies with the guidelines set forth in the Hawai'i <br /> Administrative Rules (HAR), Section 15-15-24, and with the criteria set forth in the <br /> Hawai'i County Code, Chapter 25, Section 25-4-12. <br /> A. The granting of the proposed use shall be consistent with the general purpose of <br /> the zoned district, the intent and purpose of the Zoning Code and the County <br /> General Plan: <br /> 1. HRS Chapter 205: <br /> The granting of this request would promote the effectiveness and objectives of <br /> Chapter 205, Hawai'i revised Statues, as amended. The State Land Use and <br /> Regulations are intended to preserve, protect and encourage the development of <br /> lands in the State for those uses to which they are best suited in the interest of the <br /> public health and welfare of the people of the State of Hawai'i. In the case of the <br /> Urban District, the intent is to establish boundaries for areas that are both <br /> currently in urban use, and reserve areas for anticipated planned urban growth. <br /> The land is presently used as a residential home, and church. There will be no <br /> impact to the use of the residence and church. <br /> The subject property is situated within the County RS-10 Single-Family <br /> Residential zoned district. The proposed telecommunication site would be <br /> situated on a 750 s.f portion of the subject property's 12.381 acre parcel of land. <br /> The proposed use will take minimal lands out of the residential inventory for this <br /> area and will not significantly affect the residential resource of the area. The <br /> proposed use will be confined to the 750 s.f portion of the subject property. <br /> The proposed telecommunication facility will provide wireless service to the <br /> school, nearby churches, and surrounding neighborhoods, as well as travelers <br /> 10 <br />
