The Ag-Based Commercial Operations declaration is primarily for uses that have a retail <br />component that invites customers onto the property. It is our understanding that in this case, the micro -distillery <br />will produce spirits that will be sold wholesale to other businesses and will not include an on -site customer <br />component, thus the Ag-Based Commercial Operations designation is not applicable. <br />However, in addition to the determination from our Zoning Code referenced in the previous e-mail, the proposed <br />Use Is outright permitted in the State Land Use Agricultural District per Hawaii Revised Statutes §205-4.5 <br />(Permissible uses within the agricultural districts), which states: <br />#4(11) Buildings and uses, including mills, storage, and processing facilities, maintenance ntenance facilities, photovoltaic, <br />biogas, and other small-scale renewable energy systems producing energy solely for use In the agricultural <br />activities of the fee or leasehold owner of the property, and vehicle and equipment storage areas that are <br />normally considered directly accessory to the above -mentioned uses and are permitted under section <br />205-2(d); " <br />As for the building permit, the applicants will have to work with DPW to ensure that they have the proper building <br />permit for the micro -distillery facility. <br />Please note once again that this determination is based on the information provided.
