And that's when I posed that question that's on page 6. I asked Josie <br />if there was any precedence set, and we got that letter back from Corp. Counsel. <br />Right, that was in the packet, Josie? <br />JOSIE: I gave it to you because you asked for it. <br />BERTSCH: Oh, I was the only one that got it? <br />JOSIE: I sent it to Craig and the Chair. <br />HARA: John, would you like to make a motion? <br />BERTSCH: No. I would like to get some direction. How do you want to handle this <br />before we make a motion? I don't think that this belongs under standards of conduct. <br />I think it's procedural. <br />HARA: Commissioner de Silva. <br />DE SILVA: I agree. I move to strike it. <br />MANAGO: Second. <br />HARA: Moved to strike paragraph d) To the full extent authorized by law ... <br />Carried unanimously. <br />HARA: b) Commissioners must avoid any conflict of interest with respect ... <br />BERTSCH: My comment is, " "Must avoid," is too strong. "Must attempt," might be a <br />little better because sometimes a conflict of interest isn't exactly what some may <br />perceive to be a conflict of interest may not be perceived as a conflict interest by <br />others, so to use "Commissioners must avoid any conflict of interest," is, not that I'm as <br />educated as the judge in wording, but to put it on street smarts, there's no wiggle <br />room. <br />HARA: So, you would like to amend that by saying commissioners must attempt to <br />avoid? <br />BERTSCH: Unless somebody can give me a better word. I mean, I understand the <br />meaning of it. <br />
