CHAIR: Yeah, thank you, I'd like a review of the rules. I have them right here. Rules <br />of practice. <br />PKO: 1.15 says the meetings of the Board shall be open to the public except when <br />personal matters affecting the privacy of an individual are involved, as <br />provided in Rule 4.13. <br />CHAIR: 4.13? <br />PKO: Um hmm. <br />CHAIR: Okay. <br />PKO: And it shows then again that all meetings are open. They can be held in a <br />closed session to consult with the attorney, which is not the question. Or if the <br />Board makes an affirmative finding upon request by the officer or employee <br />involved that such hearing concerns personal matters affecting the privacy of <br />an individual. <br />CHAIR: Do you want to make a case for—I'd like to recognize at this point, before we <br />move to ExecutiveI have to recognize the, what's the word, plaintiff? <br />Richard Ganigan, Richard Ganigan, is that correct? <br />GANIGAN: Yes. <br />CHAIR: Mr. Kamelamela, do you want to have a seat, too? you're <br />representing the <br />KAMELAMELA: We're representing Harry Jose— <br />CHAIR: - -right <br />KAMELAMELA: - -and Hiram Keliikoa. <br />GANIGAN: Can I use this, for my record? (holding up a tape recorder) <br />CHAIR: Yes. Before we go, we're still in open session, and we'd like to counsel, are <br />you recommending we conduct business in open session? Is there some <br />overriding purpose- <br />PKO: Well reading the petition, I didn't see what personal matters we going to be <br />discussed. But maybe he has something. <br />CHAIR: Are you comfortable proceeding in open session at this point? <br />GANIGAN: We asked for closed, yeah. <br />25 <br />
