Procedure for Requesting Modifications to <br /> County of Hawai'i Facilities, Programs, or Services <br /> April 2, 2009 <br /> Page 3 of 5 <br /> REQUESTS THAT ARE NOT REASONABLE <br /> Requests for modifications which are not considered reasonable shall not <br /> be implemented. Modifications are not reasonable if they: <br /> • fundamentally alter the nature of the program or service offered by <br /> the County; <br /> • are extremely costly and/or disruptive; and/or <br /> • pose a direct threat or a significant risk of substantial harm to the <br /> health or safety of the individual or others that cannot be reduced <br /> or eliminated by a reasonable modification. 5 <br /> In such a circumstance, the ADA Coordinator shall contact the individual <br /> to explore if there are any alternate modifications that would offer an <br /> equal opportunity to participate or access the County program, service, <br /> and/or facility. If the ADA Coordinator and the individual cannot agree <br /> upon an alternate modification or if the benefits of the modification are <br /> not clear, the ADA Coordinator shall refer the request to the ADA <br /> Coordinator's Advisory Committee for review and comment. <br /> THE ADA COORDINATOR'S ADVISORY COMMITTEE <br /> The ADA Coordinator's Advisory Committee shall be composed of <br /> individual volunteers with various disabilities from different districts of <br /> Hawai'i County who have knowledge and understanding of the <br /> Americans with Disabilities Act, who, in the opinion of the ADA <br /> Coordinator, have demonstrated an ability to solve problems and <br /> exercised sound judgment with respect to disability issues. <br /> The ADA Coordinator's Advisory Committee shall meet on an as-needed <br /> basis or conduct meetings by conference call or teleconference, <br /> whatever best suits the needs of the committee members. All members of <br /> the Committee shall, to the best of their ability, agree to attend any <br /> meeting in which voting shall take place. <br /> In the event the ADA Coordinator cannot agree upon a particular <br /> modification with an individual, the ADA Coordinator shall present the <br /> requested modification to the Advisory Committee.
