(1) The Commission shall give written public notice of any regular or special <br />meeting. The notice shall include an agenda which lists all of the items to <br />be considered at the forthcoming meeting, the date, time, and place of the <br />meeting. <br />(2) The Commission shall file the notice in the Office of the County Clerk and <br />in the Commission’s office for public inspection at least six calendar days <br />before the meeting. The notice shall also be posted at the site of the <br />meeting whenever feasible. The Commission shall not add items to the <br />agenda, once filed, without a two-thirds recorded vote of all members to <br />which the Commission is entitled; provided that no item shall be added to <br />the agenda in the manner provided herein, if it is of reasonably major <br />importance and action thereof by the Commission will affect a significant <br />number of persons. <br />(3) The Commission shall maintain a list of names and addresses of persons <br />who request notification of meetings and shall mail a copy of the agenda <br />to such persons at their last recorded address no later than the time the <br />agenda is filed under subsection (2). <br />(4) Notice of any special meeting shall be published in a newspaper of general <br />circulation in the County at least twenty-four hours in advance of the <br />meeting. <br />(d) Emergency Meetings; Notice. An emergency meeting is a meeting in which the <br />six calendar days notice requirement cannot be met. Such a meeting can only be <br />held if there is a written finding that there is imminent peril to the public health, <br />safety, or welfare and provided the following procedures are met: <br />(1) The Commission states in writing the reasons for its findings; <br />(2) Two-thirds of the members to which the Commission is entitled agree that <br />the findings are correct and an emergency exists; <br />(3) An emergency agenda and the findings are filed with the Office of the <br />County Clerk and in the Commission’s office; and <br />(4) Persons requesting notification pursuant to Rule 1-5(c)(3) are contacted by <br />mail or telephone as soon as practicable. <br />(5) A notice of the meeting shall be published in a newspaper of general <br />circulation in the County at least twenty-four hours prior to the meeting, <br />or if the requirement with respect to publication of notice cannot be met <br />because of insufficient time, the meeting notice shall be made by <br />broadcasting a minimum of three announcements in the English language <br />over an FCC licensed public radio station in the County or a television <br />station with local audience. <br />(e) Executive Meetings. The Commission may hold an executive meeting, closed to <br />the public, upon an affirmative vote, taken at an open meeting, of two-thirds of <br />the members present. The vote of each member on the question of holding a <br />meeting closed to the public and the reason for holding such a meeting shall be <br />recorded and entered into the minutes of the meeting.
