the apparent violation. The homeowner shall be <br />required to provide evidence that no violation exists <br />or to correct the violation. If a Building Code <br />violation exists, the owner shall correct the violation <br />before any further Loan processing is performed or <br />include correction of the violation as a repair item of <br />the RRP. <br />i. Lead-Based Paint Hazards. Any dwelling built before <br />January 1978 may have lead-based paint which could be <br />hazardous. If the applicant’s dwelling was built <br />before January 1978, the dwelling must be tested by a <br />State certified Risk Assessor. If lead-based paint is <br />detected in any areas where any proposed rehabilitation <br />work is to be performed, the lead-based paint hazard <br />must be mitigated. The OHCD will allow the cost to <br />mitigate any lead-based paint hazard as part of the RRP <br />loan. <br />5.3 TAXES <br />a. No applicant will be eligible for a Loan if any <br />outstanding or delinquent Real Property Taxes are due, <br />unless the applicant is on a payment plan with the Real <br />Property Tax Office. <br />5.4 TYPES OF IMPROVEMENTS <br />a. General Requirements: RRP improvements may include <br />substantial maintenance and repairs, which also <br />includes natural disaster related repairs and <br />improvements. All improvements must be physically <br />attached to the dwelling unit and shall be permanent in <br />nature. Improvements shall extend the physical life of <br />the dwelling or shall correct unsafe or unhealthy <br />conditions. No work will be permitted that violates <br />any code, ordinance regulation or law in effect at the <br />time of the application. <br />b. Eligible Improvements: <br />1. Any improvements and repairs required to increase <br />the economic life of existing dwelling units and <br />ensure a safe and healthy living environment <br />including natural disaster related repairs and <br />prevention improvements to the dwelling pre- <br />natural disaster; <br />2.
