• <br />• <br />• <br />(A major item shall be construed to be any item, the total cost <br />of which is equal to or greater than ten (10) percent of the <br />_total contract price, computed on the basis of the proposal <br />quantity and the contract unit price.) Should it become necessary <br />for the best interest of the County to make changes in excess of <br />that herein specified, the same shall be covered by an amendment. <br />The Contractor shall not start work on any alteration requiring <br />an amendment until the agreement setting forth the adjusted <br />prices shall be executed by the County and the Contractor. <br />Should any of the changes not requiring an amendment be made as <br />provided herein, the Contractor shall perform the work as altered, <br />increased or decreased at the contract unit price or prices. <br />In case a satisfactory adjustment in price canna be reached for <br />any item requiring an amendment, the County reserves the right <br />to terminate the contract as it applies to the items in question <br />or perform this work by force account as outlined in Section 9.4(b) <br />„FORCE ACCOUNT WORK*. or make such arrangements as may be deemed <br />necessary to complete the work. <br />2. Im�Sum Wo,k - Increases or decreases in projects for which a <br />lump sum price is asked will not be made on the basis of a certain <br />percentage over or under the original lump sum price bid for the <br />project. The cost of increased or decreased work will be <br />determined in accordance with Subsection 4.2(c). <br />(b) Omitted its - Should any contract item of the work be omitted by <br />the Engineer in its entirety, in the absence of a contract change <br />order covering such omission, payment will be made to the Contractor <br />for actual and direct costs, excluding overhead and profit incurred <br />in connection with such omitted contract item if incurred prior to <br />the date of notification in writing by the Engineer of such omission, <br />except as hereinafter provided for costs of handling materials. <br />If acceptable material is ordered by the Contractor for the omitted <br />item prior to the date of notification of such omission by the <br />Engineer and if orders for such material cannot be canceled, it <br />will be paid for at the actual cost to the Contractor, excluding <br />overhead and profit. In such case, the material paid for shall <br />become the property of the County and the cost of any further <br />handling will be paid for as extra work as provided in Subsection <br />4.2(d). If the material is returnable to the vendor and if the <br />Engineer so directs, the material shall be returned and the Contractor <br />will be paid for charges made by the vendor for returning the materials <br />excluding any markup for overhead and profit to the Contractor. The <br />cost of handling returned material will be paid for as extra work as <br />provided in Subsection 4.2(d). <br />Section 4 <br />Page 14 <br />
