• <br />• <br />• <br />SECTION 7 - LEGAL RELATIONS AND RESPONSIBILITY <br />7.1 LANS TO BE OBSERVED - The Contractor at all tines shall observe and <br />comply with all Federal, State, and local laws or ordinances in any manner <br />affecting the conduct of work and shall indemnify and save harmless the State <br />and the County and its representatives against any claim arising from the <br />violation of any such law, by-law or ordinance by the Contractor, subcontractor, <br />or by their respective employees. If any discrepancy or inconsistency is <br />discovered in the plans; drawings, specifications or contract for work in <br />relation to any such law, ordinance, regulation, order or decree, the Contractor <br />shall forthwith report the same to the Engineer in writing. All chapters and <br />sections hereinafter cited are references to the Hawaii Revised Statutes. <br />(a) <br />Ho_, urs of Labor (Section 104-2 - No laborer or mechanic employed <br />on the job site of any public work of the State or any political <br />subdivision thereof shall be permitted or required to work on <br />Saturday, Sunday or legal holiday of the State or in excess of <br />eight hours on any other day unless he receives compensation for <br />all hours worked on Saturday, Sunday or legal holiday of the <br />State or in excess of eight on any other day at a rate not less <br />than one and one-half times his basic hourly rate of pay. For <br />the purposes of determining overtime compensation under this <br />subsection, the basic hourly rate of any laborer or mechanic shall <br />not be less than the basic hourly rate determined by the Director <br />of Labor and Industrial Relations to be the prevailing basic <br />hourly rate for corresponding classes of laborers and mechanics <br />on projects of similar character in the State. <br />Where projects are financed by Federal Funds, appropriate Federal <br />Labor Law shall be applicable. <br />(b) Fr v lin W es (Section 104-2) - The Contractor or his sub- <br />contractor shall pay all mechanics and laborers employed on the <br />job site, unconditionally and, not less often than once a week, <br />and without deduction or rebate on any account, except as allowed <br />by law, the full amounts of their wages including overtime, <br />accrued to not more than five (5) working days prior to the time <br />of payment, at wage rates not less than those stated in the contract, <br />regardless of any contractural relationship which may be alleged <br />to exist between the Contractor and subcontractor and such laborers <br />and mechanics. The wages stated in the contract shall not be less <br />than the wages which the Director of Labor and Industrial Relations <br />shall determine to be the prevailing wages for corresponding <br />classes of laborers and mechanics on projects of similar character <br />in the State. <br />The rates of wages to be paid shall be posted by the Contractor <br />in a prominent and easily accessible place at the job site and a <br />copy of such wages required to be posted be given to each laborer <br />Section 7 <br />Page 30 <br />
