• <br />• <br />SECTION 8 - PROSECUTION AND PROGRESS <br />8.1 PROSECUTION OF THE WORK - The Contractor shall begin the work to be <br />performed under the contract within ten (10) consecutive working days from <br />the date of qUotice to Proceed41 specifiedin the written order of the Engineer, <br />including such date. The Contractor shall notify the Engineer at least three <br />(3) consecutive working days before beginning work on the portion or portions <br />previously agreed upon between the Engineer and the Contractor. At the <br />beginning of construction or at any subsequent suspension and resumption of <br />work, the Contractor shall notify the Engineer at least three (3) consecutive <br />working days before beginning actual operations. He shall start the work in <br />the area designated by the Engineer. <br />Should the Contractor begin work in advance of the notice to proceed as <br />provided above, any work performed by him in advance thereof shall be subject <br />to the following conditions and shall be considered as having been done by him <br />at his own risk and as a volunteer until the contract has been approved as <br />provided for in Section 103-34, Hawaii Revised Statutes. <br />(a) <br />Under no circumstances shall the Contractor commence construction <br />operations until he has notified the Engineer of his intentions <br />and has been advised by the Engineer in writing that the project <br />site is available to the Contractor. <br />(b) On commencing operations, the Contractor shall take all precautions <br />required for public safety and shall observe all provisions of the <br />Standard Specifications and Special Provisions relating thereto. <br />(c) In the event the contract is not approved, as provided above, the <br />Contractor shall, at his own expense, do such work as is necessary <br />to leave the site in a neat condition to the satisfaction of the <br />Engineer. The Contractor shall not be reimbursed for any expenses <br />incurred. <br />(d) All work done according to the contract prior to its approval, <br />as provided above, shall be performed in accordance with the <br />contract documents and will, if the contract is approved, be <br />considered authorized work and will be paid for as provided in <br />the contract. <br />8.2 WORKING HOURS - Prior to beginning operations, the Contractor shall notify <br />the Engineer in writing of the time in hours and minutes, A.M. and P.M., <br />respectively, at which he desires to begin and end the days work. <br />If Contractor desires to change his working hours, he shall request the <br />Engineer's approval three (3) consecutive working days prior to the date of <br />.effecting the change. <br />Work in excess of eight(8) hours in any one day or on Saturday, Sunday <br />or legal holiday of the State is permissible when approved by the Engineer in <br />Section 8 <br />Page 37 <br />
