IBARRA: All the departments--the Civil Service , Police , <br /> Liquor Control, Water Supply--has that last phrase, that shall <br /> come under the general supervision and control of the mayor. <br /> DUNCAN : Uh-huh. <br /> IBARRA : And that ' s the provision that certainly we ' d use to <br /> sort of pull the departments together. Because if the departments <br /> feel that they are autonomous, that. . .because they have their own <br /> budget--such as Water, and don' t have to have any Council <br /> appropriation--then there ' s no person giving the agencies <br /> direction and they go and that ' s what the problem I found as <br /> managing director, sometimes the agencies all go different ways ; <br /> and someone has to pull them together and give them leadership , <br /> set the direction. <br /> GREENWELL : This also is another example of a strong mayor. <br /> IBARRA: Yes. <br /> DUNCAN : Uh-huh. <br /> IBARRA : So, that ' s the a. . .that Civil Service is a creature <br /> of also, not only our Charter but state statute. So, the. . .they <br /> have to follow state law as far as the employment, the merit merit <br /> system, etcetera. The. . .and of course , Civil Service is <br /> responsible for the. . . and I 'll just give you a broad overview <br /> of. . .collective bargaining and the personnel matters of the <br /> County--the merit system, preserving the merit system. I take it , <br /> you know, these department heads will be coming before you folks <br /> in the future , as far as their specific. . . <br /> GREENWELL: Civil Service in a way should be somewhat free <br /> of political pressure. There ' s nothing in any of these <br /> sections. . .that last section that limits the general supervision <br /> and control by the mayor. You could almost take over completely, <br /> couldn ' t you? <br /> IBARRA : Except that , Mr. Greenwell, that the state statute <br /> prescribes the procedures that the director must follow, in the <br /> hiring, terminating. So, in essence, the mayor can tell the <br /> director like any other director, look , I want you to hire <br /> Employee A. But the director should be strong enough and say, <br /> look, he has to comply or she has to comply with the Civil Service <br /> laws, that is, examination, be certified in the top five and then <br /> the appointing authority interviews. . . <br /> GREENWELL : That ' s in hiring and firing. <br /> IBARRA : Yes. <br /> GREENWELL : But there are other things in other departments <br /> that he ' s given a great deal of authority over. <br /> 36 <br />
