It was not tested, because <br /> most of the departments, in fact , all of the department heads were <br /> very cooperative in that respect. We <br /> have this section in here which says the Chief of Police shall be <br /> the administrative head of the Police Department . <br /> IBARRA : Yes. <br /> BETHEA : And then it goes on to say, it has (inaudible) of <br /> the power and duties of functions as may be required by the Police <br /> Commission, which throws in a little element that. . .a little. . . I <br /> don ' t quite understand . But then there ' s a Section 7.7-2.7 which <br /> says the Police Department shall come under the general <br /> supervision and control of the mayor. Is there a conflict , or <br /> should there be greater clarity in what is meant by the statement <br /> that the chief is the administrative head and , at the same time , <br /> the Police Department shall come under the general supervision and <br /> control of the Mayor? Is that. . .is there an uncertainty there? <br /> IBARRA : The. . .the Police Commission has the authority to <br /> promulgate rules and regulations. And they did promulgate rules <br /> and regulations pertaining to the firing and the hiring of the <br /> Chief. I would. . .I would. . .I would suspect that the Police <br /> Commission, and I feel. . .should be allowed to a. . .to a. . .to tell <br /> the Chief , as far as policies , as far as. . .as far as what his <br /> functions and responsibilities are. And, as far as. . .certainly , <br /> Mr. Bethea, you can see there ' s a conflict , because if this comes <br /> under the general control and supervision of the Mayor, but <br /> yet. . .if there is a. . .the Chief can have other powers , duties and <br /> functions as may be required by the Police Commission or provided <br /> by law. (Inaudible) conflicts the Mayor (inaudible) remain under <br /> general supervision and control. But I would say that the Section <br /> C, which pertains to the powers , duties and functions should be <br /> construed only pertaining to the broad. . .broad areas in the <br /> department--powers , duties and functions--not necessarily the <br /> general everyday operation [and] administration of the department. <br /> JUVIK : Un-huh. Excuse me. Are you. . .are you saying that <br /> should in case you raised (inaudible) green harvest , are you <br /> saying that the Police Commission should be able to tell the <br /> Police Chief, yes, carry on green harvest , or no, don' t carry on <br /> green harvest? <br /> IBARRA : No, I don ' t feel that the Police Commission should <br /> have that authority , although I believe that the Police Commission <br /> 33 - <br />
