DEPARTMENTAL The Chair directed the Committee to take up the <br /> OVERVIEW: Departmental Overview. <br /> DEPARTMENT Mr. Hideo Kuniyoshi read and presented his statement- <br /> OF LIQUOR (See Attachment I - page 1) <br /> CONTROL: <br /> MR. KUNIYOSHI: Now, I' d like to explain the <br /> organizational and functional makeup of our department. <br /> At this time, Mr. Kuniyoshi submitted the organizational chart for <br /> the Department of Liquor Control. (See Attachment II) <br /> The. Department of Liquor Control is composed of three divisions. <br /> I have on the top the Mayor and Council which appoints/removes the <br /> Liquor Commission members and the Liquor Control Adjudication <br /> Board members; the Council also approves the rules and regulations <br /> of both bodies ; and the Mayor and the Council appropriates the <br /> funds. The block on the left is the Liquor Commission, this is <br /> the legislative body. The one on the right is the Liquor Control <br /> Adjudication Board which is the judicial body, and I, as the <br /> Director of Liquor Control, represent the Executive Branch. <br /> I' ll briefly try to explain the powers of each of these groups. <br /> The Liquor Commission is composed of seven members appointed by the <br /> Mayor, confirmed by the Council on a geographical basis throughout <br /> the County of Hawaii. The Liquor Control Board is made up of five <br /> members on the same basis. <br /> Item No. 1, on the Liquor Commission. It says appoint and remove <br /> the Director, primarily, after I leave the office. This refers to <br /> my successor. Prior to the Charter, I was a civil service employee <br /> and therefore with the adoption of the Charter, I am what you call, <br /> grandfathered by the Civil Rules and Regulations. It' s someplace <br /> in here, I think under the Transition of Positions. It says that <br /> all department heads or deputies who have civil service status are <br /> covered until a successor is appointed. <br /> Item No. 2, this is the primary duty of the Liquor Commission. <br /> The primary job is to consider granting or refusing, or renewal <br /> of liquor licenses. The meetings are held once a month, primarily <br /> to consider these areas. <br /> The third is the rules and regulations. From time to time we do <br /> amend the rules and regulations of the Liquor Commission, and at <br /> that time, this body is the one that does the adoption of the rules. <br /> Fourth, it says other duties provided by law not inconsistent with <br /> Charter. This refers to the State law which I just mentioned, <br /> Chapter 281. Under this state law, I made reference to <br /> Chapter 281-17. This section gives the powers and duties of the <br /> Liquor Commission. Some of these powers and duties are naturally <br /> divided with the adoption of the Charter because these powers and <br /> duties provisionally had to do with adjudicatory functions. So <br /> the powers and duties which originally were only given to one body <br /> have been divided. The adjudicatory functions are referred to the <br /> adjudication board, and such things as granting of the licenses <br /> still remain with the Liquor Commission. <br /> - 3- - <br />
