<br /> There have been instances, . Mr. Schutte, where I have dis-
<br /> agreed with their position. A lot of the disagreement came
<br /> about because I thought that they were being kind of wishy-
<br /> washy in terms of how they apply the law. For example, they
<br /> would, say, in one area--apply the guidelines, rather--in one
<br /> area a guy would have to have a mansard roof and on another
<br /> building right next to it they would say, well , that guy
<br /> would have to have a shake roof arid, they would say, no,
<br /> mansard is okay, and they would say no, fte, ' it has got to
<br /> be shake roof. Then , under that situation, I had to point ,
<br /> out in the interests of consistency what the design require-
<br /> ment would be. But aside from those kinds of instances , and
<br /> I think those instances are really more of the exception
<br /> than the rule, .I think they have provided rather critical
<br /> comments toour office. In the review of signs withinthe ,
<br /> village; in the review of how the buildings would be.
<br /> MRra SCHUTTE: But' that doesn ' t necessarily
<br /> have to do with the general planning of the areaMbut more
<br /> with the physical planning of a particular subdivision or
<br /> of a _group. . . .
<br /> MR. FUKE: More the physical planning for
<br /> buildings, roadway systems within an area, what kind of
<br /> landscaping should be, what kind of signs within the village.
<br /> Just more from a design criteria.
<br /> MR. SCHUTTE: How much of those d4cisions
<br /> influence you or influence the general 'planning, or the
<br /> Planning Department? In other words, here we have a Planning
<br /> Commission in a specific area to advise the county planner as
<br /> to, how that particular area should be developed. Yet, you
<br /> have to follow with a general plan that is adopted by law
<br /> for the general area. So, what happens in, between?
<br /> MR. FUKE: Essentially, their responsibilities
<br /> come in areas like a guy comes in with the request to put up a
<br /> structure within the Kailua village. Now, under the ordinance
<br /> evenwithout public input, I can make all the decisionsan)
<br /> terms of what the setback should be, what the heightD should
<br /> be, what the color of the building should be and what kind of
<br /> landscaping, etc. Because Kailua was deemed to be rather
<br /> unique and special , by having a commission over there to advise
<br /> and say, hey, Planning Director, in this situation I think this
<br /> building should be scaled down to make it more in concert with
<br /> the surrounding area, the landscaping should be of x, y, and z
<br /> kind of plant material. These are the kinds of input that we
<br /> would receive where, generally, if it weren ' t for the comm-
<br /> ission we would just process it as a normal building permit.
<br /> MR. SCHUTTE : Sure, but those esthetic things
<br /> don ' t come into the rules of the Planning Department. Are
<br /> they all subject to that?
