Even in last week ' s proposal , I had the general <br /> question. . . are you in favor of amending Section 3-2?. . .that <br /> would be a vote on, the status quo, really. If you say, yes, <br /> then the one option is out of the way, right? Then, if you are, <br /> what option are you in favor of, #1 , or #2? The problem with <br /> that one is you have the same problems with this. The <br /> possibility you won ' t have a majority of the vote on the two <br /> options. On either of the two options. Because only the <br /> people who vote yes are coming down to vote, right? If 51 people <br /> voted yes, you are going to have to split up 51 votes between <br /> two options. How can you possibly have a majority? And you <br /> can ' t have even the noes come down to vote because that ' s <br /> inconsistent with what they voted up there. If they vote they <br /> don ' t want any change, how can they vote for an option, right? <br /> It doesn ' t make sense. <br /> CHAIRMAN SCHUTTE : Stuart, the way you had it <br /> last week, where you had to answer yes or no on the first part <br /> of the question and then come down to the particular section, <br /> it does not relieve the majority on the bottom portion of that <br /> question? <br /> MR. ODA: That ' s right. <br /> CHAIRMAN SCHUTTE : The majority still continues? <br /> MR. ODA: Right. I initially thought otherwise <br /> but I have to correct myself because after discussion with the <br /> County <br /> gentlemen and reading the case on Kimura versus C y of <br /> options <br /> you cannot construe. that options, the vote on the <br /> any other way. IRthat particular case, it ' s like they added <br /> the votes for one of the o_pfions to the general question to get <br /> a majority vote. You can 't do that. Actually, I .tried to add <br /> part one and part two to get a majority. Part two was short, <br /> you know. <br /> CHAIRMAN SCHUTTE : Any further discussion? ;Stuart, <br /> unless you have more to say regarding this particular section, <br /> before I get back to you, I ' d like to go to Bill Kikuchi.
