permitted in the designation of occupancy of certain <br />developments for older persons (including elderly <br />people with disabilities). <br />2. Eligible applicants for participation in this program <br />include: <br />a. Those who qualify as a family as defined in <br />Paragraph B herein; and <br />b. Those whose annual income, as defined in Paragraph <br />F, does not exceed the income limits prescribed by <br />HUD as set forth in the CFR and any amendments <br />made thereto from time to time; <br />c. Families, the members of which are citizens or <br />eligible non-citizens as provided in the CFR; <br />d. The OHCD will accept applications only from <br />families whose head of household or spouse is at <br />least eighteen years of age or an emancipated <br />minor under State of Hawai`i law. <br />3. A family may be declared ineligible for rental <br />assistance if: <br />a. Any member of the Family has an outstanding <br />balance owed to the OHCD, another PHA in <br />connection with any public assisted program or <br />project that receives funds under the United <br />States Housing Act of 1937 or amendments thereto, <br />the State of Hawai’i, or the County of Hawai’i; <br />except that if the applicant repays the entire <br />outstanding balance owed to the OHCD, another PHA <br />which receives funds for housing purposes. Such <br />ineligible Family may again be eligible for rental <br />assistance upon repaying the entire outstanding <br />balance owed to the OHCD, another PHA or project <br />which receives funds for housing purposes or upon <br />the Participant’s entering into a repayment <br />agreement with the Agency and does not breach said <br />agreement. Applicants who have an outstanding <br />balance due with any PHA or project shall be <br />allowed on the Waiting List but shall be denied <br />admission to the Program unless and until such <br />outstanding balance has been paid in full by the <br />time the Applicant is on the top of the Waiting <br />List and the Agency is then determining the <br />eligibility of the Applicant for the Program. <br />Rules and Regulations <br />-32- <br />0010ARslh-TBRA <br />11/01/2007 <br /> <br />
