I guess it's just an ordinance somewhere? <br />MR. HENRICKS: I would say that Mr. Brilhante knows the answer to that. <br />MR. BRILHANTE: My understanding is Section 7-1.2 is the predominant <br />authorization for the Merit Appeals Board. I'm going to defer to Corp. Counsel. <br />That's outside of the County. HRS (Hawai`i Revised Statutes) specifically has a <br />section which identifies each jurisdiction's merit appeals board and the functions. <br />CHR. ADAMS: And it lists the functions, powers, responsibilities that are there? <br />Okay. The idea is that we don't cross paths with that. That's why we don't have <br />anything in the Charter specifically necessarily? Okay. <br />MR. BRILHANTE: Well generally, the HRS would supersede the language we <br />have in the Charter anyway, if it contradicted. <br />CHR. ADAMS: If it's a general law. Or a law of general applicability. <br />Otherwise the Charter supersedes, interestingly enough. According at least to my <br />review. I would again—but anyway, for these purposes the information that <br />we're talking about having to do with powers, responsibilities and function, is <br />going to be found in the HRS. So that's great. Okay, because other places there's <br />more information and it lists more of the responsibilities. And this is a Charter <br />department. So that's fine. <br />Okay, are there any other—I see Commissioner Todd. <br />MS. TODD: Just for reference if people want to look it up, it's under Section 76- <br />47 of the Hawai`i Revised Statutes. It's under Section—under the Civil Service <br />system for the State. So generally, my recollection is that those provisions, <br />because they apply to all of the counties, are considered general law. <br />CHR. ADAMS: Correct. Okay, seeing no other questions, Director we really <br />appreciate you corning before us and making your presentation and answering our <br />questions. If we have any additional questions—and I would also invite you if <br />you have any additional thoughts that you'd like to relay to us during our <br />deliberations, please, you're welcome to do that. <br />MR.
