I <br />don't see that in the Maui text and I think it's important to allow <br />for that. <br />Very good comment thank you. <br />Another thing I just wanna say if you're gonna replace the whole <br />language with the Maui...I think one thing that is very good in <br />Maui is that...it says (b) if the board votes to hold the informal <br />hearing in executive session, the respondent may request an open <br />hearing, in which case an open hearing shall be held. I think that <br />might be a wise provision if somebody wants to have it out in the <br />open that we should allow that. <br />Yeah. And we've always given people who come here an option <br />for open or closed...either way. You know when they come that's <br />the first question that we ask you know do you want this to be a <br />closed hearing and we've always honored that request and if it <br />should come in executive session it would be kind of a closed <br />hearing anyway because...executive session indicates that nobody <br />else can be in here so I'm not quite sure...I wouldn't even put <br />that...that's something that they definitely have the prerogative of <br />doing. Yeah so I have a question to counsel. So let's say I'm a <br />citizen and I'm concerned about a specific county employee doing <br />something that I think is unethical right cause the big part here is <br />we're only talking about unethical not illegal behavior right <br />because illegal will take you to a whole other...another level you <br />know and then we're talking court and then we're talking you <br />know coming with your attorney or... <br />We always have the option to refer like oh prosecutor right. Well <br />that could happen yes. <br />But let's say it's an unethical thing but I don't know anything <br />about the Board of Ethics...I've never heard of it you know. Can I <br />call your office and just ask simple questions as to how the <br />procedure works...what you would recommend for me...is that <br />something that is a practice or not. <br />I know that, I know that's our policy...we usually...or our <br />practice...this board normally acts like that...they'll give <br />permission for the respondent or whoever to request and have their <br />request honored. But somebody who comes in and doesn't know <br />that that's our policy might come in and then be blindsided <br />9 <br />
