Hawai`i County Charter Commission -5 November 9, 2018 <br />MS. RICE: I'd like to make a new motion that will strike the words "within <br />each calendar year" in the motion on the floor. <br />CHR. ADAMS: Is there a second? It's been seconded by Commissioner <br />Galimba. So just for the purposes... if I may? So for the purposes of the <br />amendment, the motion would read that the County Council hold an equal <br />number of its regular meetings in East or West Hawai`i. <br />MS. RICE: Should say "provided that." <br />CHR. ADAMS: Mr. Henricks, you have it directly in front of you. Can you <br />read it with the amendment? <br />MR. HENRICKS: I'll just read the full sentence just for the record. <br />CHR. ADAMS: Thank you. <br />MR. HENRICKS: "The county council shall meet regularly at least twice in <br />every month at such times and places as shall be established by rule of the <br />council, provided that the council shall hold an equal number of its regularly <br />scheduled meetings in East Hawai`i and West Hawai`i." Period. <br />CHR. ADAMS: Okay. You have anything you'd like to add under discussion <br />since you made the amendment? <br />MS. RICE: That just simplifies it and it gives flexibility to the Council in case <br />something comes up where they simply can't get across the mountain because <br />the roads are closed or whatever might happen. <br />CHR. ADAMS: Mr. Yoshimoto. <br />MR. YOSHIMOTO: So I would add a little bit more rationale, so the record <br />is clear as to why this amendment addresses the issue that we were just talking <br />about, about emergencies, if we could just have that so that we would have <br />some basis, additional basis, for what your amendment does. <br />MS. RICE: Yeah. <br />CHR. ADAMS: Okay, so for the purposes of establishing rationale, we <br />recognize that there are times, particularly on this island, when we may not be <br />able to have the transportation means or even the telecommunication means to <br />hold a meeting within the rules that the Council sets up. And so the idea of <br />not including the timeline helps with not incurring a penalty under the <br />Page 31 <br />
