years of adoption of the ordinance and be completed within ten years. So, that was the original
<br />requirement that is still in the ordinance.
<br />The Applicant is requesting to get relief from the curb, gutter, sidewalk requirement. They are
<br />still proposing to construct the, to provide pavement basically for the full 80 -foot right-of-way
<br />from Komohana to Mohouli, and then not, and then dedicate that to the County at no cost. And,
<br />then when they sell off like the bulk lots for other developers to come in and do a subdivision
<br />development, that developerI'm sorry, that's the Director's Recommendation. So, I'm
<br />confusing you. So, that's what they are proposing. Their condition, if you look at Condition P,
<br />says, I want to point out the third paragraph on the back of the second page. It says this does
<br />not this is the back page of the white sheet.
<br />IKEDA: It's this one?
<br />JACKSON: It's dated March 7th on the top. Yeah, it's one that you just received today. So, if
<br />you—if you look at the back side of that, Commissioner Ikeda, do you see where it says on the
<br />second paragraph, "This does not preclude the applicant or its successors or assigns from making
<br />further improvements, such as a 4 -lane road with curbs, gutters, [and] sidewalks within the 80 -
<br />foot [wide] right-of-way." So, the essential difference between what the Applicant is proposing
<br />and what the Director is recommending is that the Applicant's condition is saying we'll build out
<br />with the pavement till 80 feet and that this, this condition is not preventing future developers
<br />from coming in and providing curb, gutter, sidewalk improvements, but it's not actually
<br />requiring that. It's just saying if a future developer choses to, they can put curb, gutter, sidewalk
<br />improvements. The Director is recommending that that's actually a requirement, that as
<br />developers come out—as individual developers develop their properties that they add the curb,
<br />gutter, sidewalk improvements along the street extension. So, that's the primary difference.
<br />Does that make sense, or do you still have questions on that one?
<br />IKEDA: I'm getting confused. Okay, the, the planner suggested that 80 -foot right-of-way?
<br />JACKSON: The General Plan.
<br />IKEDA: Yes. And, so what is the paved section? Is it going to be all 80 feet?
<br />JACKSON: A1180 feet like Mohouli Street. They paved that entire
<br />IKEDA: —What concerns me, okay, and then what is going to be the designated roadway?
<br />Forty feet? Because like Mohouli Extension, only a portion of it is
<br />JACKSON: —Yeah. So, it would likely start out as a two-lane road with probably 12 -foot
<br />travel lanes, two 12 -foot travel lanes. But, I'm not certain. It's really up to Public Works to
<br />decide how large the travel lanes are.
<br />IKEDA: Yes, you know why. Because I'm kind of curious because, you know, the Mohouli
<br />Extension is made with government money, and, there's no curb, gutters, or sidewalks on it, and
<br />it rests on the poor developer. They gotta put in curb, gutters, and sidewalk.
