The first draft is <br /> being replaced because there was an error in the Tax Map Key Number. <br /> This quitclaim deed is being offered for the Council's acceptance as part of a situation <br /> which dates back to ] 983, when Kamehameha Investment Corporation (KIC), as a condition of <br /> rezoning, dedicated a piece of real property to the County for use as a fire station. This parcel is <br /> located on Alii Drive, near the Shopping Center in Keauhou. One of the deed conditions stated <br /> that if the County had not built a fire station on the property within fifteen years of the dedication <br /> (September 7, 1998), the property would revert to KIC. Later, the Fire Department determined <br /> that this lower Keauhou property is inappropriate for use as a fire station for two reasons: first, <br /> the site is too small. Second, the grade of Kamehameha III Road is too steep for fully loaded fire <br /> trucks to ascend, which would cause difficulty in responding to those fires located in the mauka <br /> area of South Kona. With the reversion deadline approaching, the County decided to pay KIC <br /> for a larger piece of real property located on Puuloa Road, with a fire station already built. <br /> Inasmuch as this is improved real property, it is not subject to Chapter 103D of the Hawaii <br /> Revised Statutes, the Procurement Code. With the station now completed, KIC is presenting the <br /> quitclaim deed for the Council's acceptance. The lower Keauhou property will revert to KIC in <br /> 1998. <br /> fk~'atal.
