COUNTY OF HAWAII STATE OF HAWAII ..........e RESOLUTION NO. 230 09 RESOLUTION AUTHORIZING THE ABANDONMENT OF ROAD REMNANT "R" (PORTION OF TAX MAP KEY: (3)2-6-010), AND EXCHANGE OF REAL PROPERTY WITH PAULETTE L. PANG-CHING (TAX MAP KEY: (3)2-6-010:039), AND LAWRENCE S. OJIRI AND GWEN S. OJIRI (TAX MAP KEY: (3)2-6-010:079), SITUATE AT KAIWIKI, SOUTH HILO, HAWAII. BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII. WHEREAS, due to heavy rain, Kaiwiki Road, which is owned and maintained by the County of Hawaii, across from Paulette L. Pang-Ching (Pang-Ching), Tax Map Key: (3)2-6-010:039, and Lawrence S. Ojiri and Gwen S. Ojiri (Ojiris), Tax Map Key: (3)2-6-010:079, has collapsed, undermining the roadway; and WHEREAS, the County of Hawaii is the owner of a right-of-way designated as Remnant "R," (outlined in yellow on the map attached hereto as Exhibit "A"), containing an area of 23,343 square feet, that is not in use; and WHEREAS, in order to alleviate this problem and repair the roadway, the County has cut into the opposite bank to expand the roadway away from the collapsed area; and WHEREAS, these improvements will cause the need for land to be acquired from the Ojiris and Pang-Ching for use by the County to reconstruct the roadway; and WHEREAS, Pang-Ching and the Ojiris have agreed with the County to exchange that portion of their parcels needed by the County for equal parcels of unused County rights-of-way on the opposite side of their properties, as follows: 1) Lot A-1 (12,849 sq. ft.) will be conveyed to the County by the Ojiris (outlined in pink of Exhibit "B" attached hereto. 2) Easement A-2 (1,756 sq. ft.) for access and utility purposes will be acquired by the County from the Ojiris (cross-hatched in green on Exhibit "B" attached hereto. 3) Parcel (13,862 sq. ft.) will be conveyed to the Ojiris by the County (outlined in green on Exhibit "B" attached hereto.
