<br /> acquire the above-mentioned road reserves and real properties from Lanihau Properties, LLC; <br /> <br /> and <br /> WHEREAS, Lanihau Properties, LLC has agreed to exchange the above-mentioned road <br /> <br /> reserves and real properties for the site of Sewage Pumping Station No. 4 and Area "C"; and <br /> WHEREAS, the exchange of real properties and road reserves, while not equal in size, is <br /> advantageous to the County and allows for the straightening, expansion and acquisition of <br /> encroachment areas; and <br /> WHEREAS, Section 2-115 of the Hawaii County Code permits the exchange of real <br /> <br /> property for private property, and Section 2-118, Hawaii County Code, allows for the disposal <br /> of remnant parcels. <br /> NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF <br /> <br /> HAWAII, that in accordance with Section 2-115 of the Hawaii County Code, the County of <br /> Hawaii accepts the following: <br /> Road Reserve Lot A-l TMK: (3)7-5-004:027 (por.) 1,252 sq. ft. <br /> Road Reserve Lot C-1 TMK: (3)7-5-004:034 (por.) 753 sq. ft. <br /> Area "A" TMK: (3)7-5-004:028 (por.) 65 sq. ft. <br /> Area "B" TMK: (3)7-5-004:038 (por.) 7 sq. ft. <br /> Area "L" TMK: (3)7-5-004:038 (por.) 250 sq. ft. <br /> (see Exhibits "B" and "C") from Lanihau Properties, LLC, in exchange for real property <br /> identified as Tax Map Key: (3)7-5-005:067, containing an azea of 2,248 square feet, which is the <br /> site of Sewage Pumping Station No. 4 (see Exhibit "A"), and Area "C," identified as being a <br /> portion of Tax Map Key: (3)7-5-004:028, containing an area of 150 square feet (see <br /> Exhibit "B"). <br /> BE IT FURTHER RESOLVED that the County Clerk shall transmit a copy of this <br /> resolution to (1) the Mayor Harry Kim; (2) William Takaba, Director of Finance; <br /> 2 <br /> <br />
