Lettter dated January 4, 1995 from the Planning Commission to the <br />County Council with recommendations for rezoning specifically on Page <br />4 : re Punahele access and Page 5 & 6, re: common boundaries buffer <br />issues. (Exhibit 9) <br />Ordinance 95-33 re: rezoning conditions, effective March 17, 1995. <br />(Exhibit 10) <br />Letter from Dr. Takase to Haitsuka Brothers dated January 12, 1995 <br />re: baseyard usage requesting mitigation on behalf of neighbors <br />bordering baseyard. It should be noted that "subject property" and <br />PPB/Rehab property were not cleared and graded until June of 1994, <br />in preparation for the baseyard which neighbors had not be informed <br />of and County allowed for its project. (Exhibit ii) <br />Letter from Dr. Takase to Haitsuka Brothers dated May 17, 1995, <br />again re: baseyard usage mitigation and usage of Punahele as an <br />access (Ord. 95-33 violation), and, in paragraph 1 ..."We would like <br />your assistance in locating these materials and al items which may <br />infringe upon the privacy (what little they may have left) as far away <br />fro the private residences as possible..." The current parking lot <br />proposal obviously has the same effect. (Exhibit 12~ <br />Minutes by M&E Pacific of June 2, 1995 meeting re Haitsuka Brothers <br />issues. jExhibit 13) <br />My letter dated June 19, 1995, re Haitsuka's following the mitigation <br />meeting and non-compliance to mitigation issues. (Exhibit 14) <br />Throughout early 1995, I continued to make oral reports to Mr. William <br />Yamanoha of the Planning Department who said he would look into the <br />matter each time. I discussed our concerns with Mr. Jiro Sumada, <br />Deputy Engineer -Public Works, and Ms. Virginia Goldstein, Planning <br />Director. Both visited Haitsuka's baseyard. Mr. Sumada met with <br />Gerald Takase at the site to discuss mitigation and the accessing of <br />Punahele during this period. Mr.Sumada also came to the site at least <br />three other times to discuss ongoing non-compliance of dust and <br />access issues with Haitsukas. It should be noted that only <br />"complaints" were addressed and no followup to complaints were <br />made unless more complaints were communicated. Ms. Goldstein <br />came twice to inspect water runoff into the Gushiken and Reis <br />properties as well as the non-compliance of the Punahele access. <br />5 <br />
