<br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> AUTHORITY <br /> <br /> The Development Agreement has been prepared pursuant to: <br /> <br /> • Chapterr 46-123 of the Hawaii Revised Statues <br /> <br /> • Ordinance No. 93-37 of the Hawaii County Code <br /> <br /> • Office of the Mayor Rule No. 1 <br /> <br /> PURPOSE OF THE DEVELOPMENT AGREEMENT <br /> <br /> The proposed Development Agreement between Hawaii County (County) and Oceanside 1250 <br /> (Oceanside) is for the following purposes: <br /> <br /> • To identify the obligations of Oceanside towards certain improvements. <br /> <br /> • To provide assurance to the County that the obligations of Oceanside will be met <br /> in a timely manner. <br /> <br /> • To provide assurance to Oceanside that the Hokukano Project (Project) will not be <br /> unduly restricted nor prohibited. <br /> <br /> • To provide assurances to Oceanside that it may complete the development of the <br /> Project in accordance with the permits and approvals granted by the County. <br /> <br /> • To assure completion of certain community benefits. <br /> <br /> • To set forth the terms and conditions of a reimbursement agreement between the <br /> County and Oceanside for costs incurred for the construction, land acquisition and <br /> design of the Bypass. <br /> <br /> 0 To allow the County and Oceanside to enter into a reimbursement agreement for <br /> costs associated with the Bypass. <br /> <br /> <br /> <br /> <br /> Development Agreement Executive Summary <br /> 2 <br />
