Mr. Zendo Kern, Chairman <br />Windward Planning Commission <br />May 27, 2011 <br />Page 2 <br />with two votes in favor and two votes against. By Rule 2 -28.1 (Community <br />Development Plan), Hawaii County Code, the Windward Planning Commission's non- <br />action constituted an unfavorable recommendation on the Bill 194. However, Bill 194 <br />was passed by a 7 -2 vote of the Hawai`i County Council and signed into law by Mayor <br />Kenoi on November 4, 2010. <br />Subsequent to the adoption of Ordinance No. 10 -104 (Bill 194), the Planning Director <br />initiated four (4) of the six (6) additional amendments recommended by the PCDP AC, <br />which were considered by the Windward Planning Commission at its February 3, 2011 <br />meeting. The Commission issued a favorable recommendation for three (3) of those <br />amendments following the withdrawal of the fourth proposed amendment due to <br />overwhelming public testimony in opposition. <br />On May 17, 2011, the Hawaii County Council approved the initial three (3) additional <br />amendments to the Puna CDP initiated by the Planning Director and recommended by the <br />Puna CDP Action Committee. <br />Now that those initial three (3) additional amendments have been adopted, these final two <br />(2) additional amendments recommended by the PCDP AC can be introduced for <br />consideration and recommendation by the Windward Planning Commission and action by <br />the Hawaii County Council. <br />PLANNING DIRECTOR'S RECOMMENDATIONS ON ADDITIONAL <br />AMENDMENTS RECOMMENDED BY THE PUNA CDP ACTION <br />COMMITTEE <br />By letter dated April 16, 2010, the Director received the recommendations of the PCDP <br />AC. Of the six additional amendments recommended by the PCDP AC that I agreed to <br />introduce for adoption, the remaining two include one (1) substantive amendment and <br />one (1) non - substantive amendment containing formatting, spelling and grammar <br />changes, which are being presented by this petition as follows: <br />1. Amendment proposed by PCDP AC by adding the word "Preliminary" to the <br />boundary title in the map legends for the Regional Town Centers, Community <br />Village Centers and Neighborhood Village Centers in Figures 5 -1 through 5 -11 <br />inclusive. <br />The legends in the original version of these maps as adopted in November 2008 <br />included the word "Preliminary" in the description of each village center <br />
