7. March 25, 2010: The Planning Director issued a"Recurring Violation" warning letter <br /> based on inspector observations of more than one tour related minivan parked on the <br /> subject properties for weeks at a time during 2009 and 2010. <br /> 8. January 26, 2012: The Planning Director issued a Notice of Violation and Order <br /> requiring removal of more than one tour related minivan from the subject parcels and the <br /> payment of a$500 civil fine. The violation was closed due to completion of corrective <br /> actions on July 10, 2012. <br /> 9. February 15, 2013: The Planning Director granted an administrative time extension until <br /> March 10, 2018 to comply with Condition C (Conversion of Dwelling into Office Uses) <br /> of Ordinance No. 08 20. <br /> STATE AND COUNTY PLANS <br /> 10. State Land Use District: Urban. <br /> 11. General Plan LUPAG Map Designation: Medium Density Urban. <br /> 12. County Zoning: Neighborhood Commercial-10,000 square feet (CN-10). <br /> 13. Hilo Community Development Plan (CDP): The Hilo CDP, adopted as Planning <br /> Commission Resolution No. 1 on May 21, 1975, identifies the property for residential <br /> use. <br /> 14. Special Management Area (SMA): The subject property is not situated within the <br /> County's Special Management Area and is located approximately 0.75 miles from the <br /> nearest coastline. <br /> DESCRIPTION OF SUBJECT PROPERTY AND SURROUNDING AREA <br /> 15. Subject Property: The project site consists of two contiguous parcels. Parcel 25 is <br /> approximately 19,607 square feet in size and improved with a two-story, 2,555 square- <br /> foot dwelling built in 1925 and an approximately 1,129 square-foot storage building built <br /> around the same time as the main dwelling that is attached to the main dwelling by a <br /> covered walkway. The applicant is using approximately 900 square feet of this structure <br /> for office use in support of their tour business. There are also two (2) utility sheds totaling <br /> 426 square feet, which were built in 1930 and landscaping. Parcel 26 is approximately <br /> 20,164 square feet in size, is improved with a one-story, 836 square-foot dwelling, built <br /> -4- <br />
