X10 06 <br /> A RESOLUTION DETERMINING THE SUFFICIENCY OF THE PETITION (ORIGINAL AND <br /> SUPPLEMENTARY) FILED BY THE SAVE OUR LAND CITIZENS' COMMITTEE ON MAY 17, <br /> <br /> JUNE 16, AND JUNE 19, 2006, PROPOSING TO AMEND CHAPTER 2, ARTICLE 42, <br /> HAWAII COUNTY CODE RELATING TO PUBLIC ACCESS, OPEN SPACE, AND NATURAL <br /> RESOURCES PRESERVATION FUND <br /> WHEREAS, the power of voters to propose ordinances is known as initiative, and <br /> is authorized in Article XI, Hawaii County Charter; and <br /> WHEREAS, on May 17, 2006, the Save Our Land Citizens' Committee filed an <br /> initiative petition entitled "Initiative petition-amending Chapter 2, Article 42, of the <br /> Hawaii County Code" with the Office of the County Clerk; and <br /> WHEREAS, the petition proposed an ordinance to amend Chapter 2, Article 42, <br /> Section 2-214, Hawaii County Code 1983 (2005 Edition), relating to the Public Access, <br /> Open Space, and Natural Resources Preservation Fund (see Exhibit "1"); and <br /> WHEREAS, it is determined that the Committee needs 4,846 valid signatures of <br /> qualified voters to be deemed sufficient (32,305 total votes cast for mayor in the 2004 <br /> special election x 15% = 4,846 qualified voters); and <br /> WHEREAS, according to the County Clerk's "Certificate of Insufficiency" (see <br /> Exhibit"2", Exhibit"D") dated June 5, 2006, the original petition, which contained <br /> 409 pages and 3,001 signatures, was determined to contain 1,366 signatures of <br /> qualified voters of the County; and <br /> WHEREAS, pursuant to Section it-5(a), Hawaii County Charter, the Save Our <br /> Land Citizens' Committee requested to amend the petition; and <br /> WHEREAS, on June 16, and June 19, 2006, the Save Our Land Citizens' <br /> Committee submitted supplementary petition pages, containing a total of 5,781 <br /> signatories, for a total of 8,782 signatories on the petition; and <br /> <br />
