No. 526/Bill No. 168, reports as <br /> follows: <br /> Bill No. 168 transmitted by Mayor William P. Kenoi, via Communication No. 526, dated <br /> December 21, 2011, is an ordinance amending section 25-8-23 (Mountain View Zone map), <br /> Article 8, Chapter 25 (Zoning Code) of the Hawai`i County Code 1983 (2005 Edition), by <br /> changing the District Classification from Single Family Residential— 10,000 square feet(RS-10) <br /> to Village Commercial— 10,000 square Feet (CV-10) at `Ola`a, Puna, Hawai`i, covered by Tax <br /> Map Key: 1-8-002:064. Also enclosed was a favorable recommendation from the Windward <br /> Planning Commission Chair Zendo Kern. <br /> At the January 19, 2012 Planning Committee, Attorney Kenny Goodenow, representing neighbor <br /> Susan Langer, who opposes this zone change request, presented a PowerPoint presentation <br /> outlining Zoning and General Plan precedents, and traffic increase concerns, plus the lack of a <br /> need for an auto repair shop business. There was discussion regarding the intended use of the <br /> property and the zoning, as well as the possible traffic increase through a dangerous intersection. <br /> Bill No. 168 was postponed to the Call of the Chair to allow the applicants and neighbors to meet <br /> with a mediator. <br /> At the May 16, 2012 Planning Committee, Aubrey Summers, representing the applicants Donny <br /> Souza&Melissa Mulliken, presented a PowerPoint presentation showing that the Puna <br /> Community Development Plan (PCDP) identifies the parcel within the Community Village <br /> Center boundary, and the Land Use Pattern Allocation Guide medium density boundary also <br /> includes the parcel. She also stated that both the Planning Department and the Planning <br /> Commission recommended a favorable determination for the applicants. At the May 16, 2012 <br /> Planning Committee, Bill No. 168 was again postponed to the Call of the Chair. <br /> Applicants Donny Souza& Melissa Mulliken and their representatives Aubrey Summers and <br /> Charles Umemoto were present in Hilo. Mr. Souza stated that since the last postponement they <br /> have taken ownership of Nichols Road on July 9, 2012 and he has obtained his State Mechanics <br /> License. <br /> PC Rept.No.: 63 <br />
