These entitlements and descriptions are: <br /> a. Rezoning Ordinance 01-22,which became effective on March 6,2001. This <br /> ordinance rezoned the subject parcels into the resort V-25. The rezoning was <br /> designed to enable the then landowner to develop a small 40-room inn called"Trees <br /> of Kukuihaele", a project that was abandoned. <br /> Said approval was subject to a number of conditions,many of which were time <br /> sensitive and never fulfilled or addressed. These included,for example, securing and <br /> paying the appropriate water commitment fee(Condition C); securing final <br /> subdivision and/or plan approval(Condition D); and other conditions leading up to <br /> securing either final subdivision or plan approval. <br /> Although that project never materialized, one of the more significant conditions <br /> relating to the enlargement of the existing residential lots at"Tiger Camp"was <br /> fulfilled. As noted earlier,however,most if not all of the remaining conditions were <br /> never implemented. . <br /> b. Use Permit No. 05-002, which was approved by the Planning Commission on April <br /> 1, 2005. In early 2005 that subject properties were conveyed to the current <br /> landowner,Kukuihaele Plantation House, LLC("KPH"). KPH then authorized <br /> World Healing Institute to apply for a Use Permit for a children's convalescent center <br /> on the subject properties. The facility was intended to provide holistic healing <br /> programs for up to ten(10)children in a residential environment.
