It was then used as a residence <br /> with several foster children until the end of 2013. The dwelling has since been vacant,with <br /> minor renovation work done during that period. <br /> KPH has no plans to utilize the property in accordance with the existing ordinance or <br /> Use Permit and instead wishes to have them used as three(3) large residential lots. The <br /> existing entitlements with their conditions,however,complicate how those properties can be <br /> used, as well as have an effect on the real property tax rate. <br /> The last condition of Ordinance 01-22 states that"Should any of the conditions not <br /> be met or substantially complied with in a timely fashion, the Planning Director may initiate <br /> rezoning of the area to its original or more appropriate designation. "Inasmuch as the <br /> conditions have not been and will probably not be substantially complied with,KPH <br /> respectfully requests your taking steps to initiate the: <br /> a. Revocation of Use Permit No. 05-002; <br /> b. Rezoning of TMK: 4-8-006: 003 and 069 into the RS-5a district and TMK: 4-8- <br /> 006: 013 into the RS-l0a district; and concurrently, <br /> c. Revocation of Ordinance 01-22. <br /> The subject properties currently have three(3)water meters. The Department of <br /> Water Supply's water availability policy applicable to this site limits only one (1)water <br /> meter per existing lot of record. Hence,the suggested RS-5a and RS-l0a zoning for the <br /> appropriate parcels would eliminate the prospects of any of them from being further <br /> subdivided,thus fulfilling the Zoning Code's concurrency requirement. <br /> On behalf of the landowner—who has also agreed to this revocation and downzoning <br /> action as evidenced by the attached letter—we respectfully request your taking the <br /> appropriate revocation and downzoning actions.
