Settlement Agreement has been implemented through subdivision approvals that did not <br />require rezoning or SMA permits. (See Exhibit A - State Land Use Boundary <br />Amendment, Change of Zone and Special Management Area Use Permit <br />Applications and Exhibit B - Settlement Agreement for Board of Appeals and <br />Subdivision of Continental Pacific, LLC Lands) <br />STATE AND COUNTY PLANS <br />2. State Land Use Designation: Agricultural and Urban. <br />3. GP LUPAG Map: Low Density Urban, Industrial, and Open along the shoreline. <br />4. County Zoning: Single Family Residential (RS -7.5), Agricultural (A -20a), General <br />Industrial (MG -5a), Limited Industrial (ML -20) and Village Commercial (CV -10). <br />5. Coastal Zone Management, HRS, Chapter 205A: The entire State of Hawaii lies <br />within the Coastal Zone Management Area. The intent of the Coastal Zone Management <br />Program is to guide and regulate public and private uses in the coastal zone management <br />area with respect to recreational resources, historic resources, public access to the <br />shoreline, scenic and open space resources, coastal ecosystems, marine resources, <br />economic uses, coastal hazards, managing development, public participation, and beach <br />protection. <br />Special Management Area (SMA): The Special Management Area is a part of the <br />Coastal Zone Management Program and regulated by the County. Portions of the <br />properties along the shoreline are located within the Special Management Area. This <br />area is not located within the County Civil Defense Agency's evacuation area for hazards <br />due to tsunami and surges from hurricanes. There is some cause for concern for tsunami <br />inundation at Pepeekeo Point. <br />DESCRIPTION OF SUBJECT PROPERTIES AND SURROUNDING AREA <br />7. Subject Properties: The subject properties are located makai of the Hawaii Belt Road <br />approximately '/< miles north of Pepeekeo. The Hilo Coast Processing Company's former <br />base yard warehouse and office space structure is located on a portion of the project area <br />proposed for the State Land Use Boundary Amendment from Agricultural to Urban and a <br />Change of Zone (A -20a to ML -20). The remaining area is vacant of any structures, and <br />heavily vegetated with abandoned sugarcane, guava, kukui nut trees, and alien plant <br />species. <br />-3- <br />
