COUNTY OF HAWAII <br />STATE OF HAWAII <br />RESOLUTION NO. 551 08 <br />RESOLUTION AUTHORIZING THE PAYMENT OF FUNDS OF A LATER FISCAL <br />YEAR AND OF MORE THAN ONE FISCAL YEAR FOR AMULTI-YEAR <br />CONTRACT FOR AWASTE-TO-ENERGY FACILITY <br />WHEREAS, Section 10-11 of the County Charter requires that any contract, lease or other <br />obligation requiring payment of funds from the appropriations of a later fiscal year or more than one <br />fiscal year be approved by resolution; and <br />WHEREAS, the Hilo Landfill is anticipated to close in approximately four years; and <br />WHEREAS, the County issued a Request For Proposal (RFP) to provide an alternative <br />method of disposing of the solid waste currently handled by the Hilo Landfill; and <br />WHEREAS, the preferred proposal pursuant to the RFP was for aWaste-To-Energy facility; <br />and <br />WHEREAS, construction of aWaste-To-Energy facility requires capital investment; and <br />WHEREAS, when this investment can be depreciated over more than one year, annual costs <br />to the County will be more competitive; and <br />WHEREAS, the RFP called for adesign-build-operate proposal; and <br />WHEREAS, the County now finds it in its best interest to contract for private services of a <br />provider to design, build and operate aWaste-To-Energy facility with atwenty-year agreement, with <br />one five-year option to extend contracted services. <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII <br />that in accordance with Article X, Section 10-11 of the Hawaii County Charter, the Mayor is hereby <br />authorized to enter into amulti-year contract for services of designing, building and operating a <br />Waste-To-Energy facility subject to a six month review period for value engineering with an option <br />to cancel by the County Council and a review after completion of the EIS and power purchase <br />
