12. Section 25-6-52 (Minimum land area required) states, "The minimum land area <br /> required for an agricultural project district shall be five acres." <br /> 13. Section 25-6-53 (Permitted uses; overall density) states, "Any uses permitted either <br /> directly or conditionally in the A or IA districts shall be permitted in an agricultural <br /> project district, and the overall density permitted in an agricultural project district shall <br /> not be greater than one acre per building site. Each of the proposed uses and the <br /> overall densities for dwelling uses shall be contained in a master conceptual plan for <br /> the agricultural project district and in the agricultural project district enabling <br /> ordinance." <br /> <br /> 14. Section 25-6-55 (Conditions imposed on agricultural project district) states, <br /> "(a) The council may impose conditions on the use of the property subject to the <br /> agricultural project district, provided the council fords that the conditions aze: <br /> (1) Necessary to prevent cit~cutnstances which may be adverse to the public <br /> health, safety and welfaze; or <br /> (2) Reasonably conceived to fulfill needs directly emanating from the land <br /> uses proposed with respect to protection of the public from the <br /> potentially deleterious effects of the proposed uses, or fulfillment of the <br /> need for public service demands created by the proposed uses. <br /> "(b) In addition to the conditions described in subsection (a), the council shall include <br /> the following conditions in any agricultural project district ordinance: <br /> (1) A description of each of the uses proposed in the agricultural project <br /> district; <br /> (2) The overall and average densities for dwelling uses established in the <br /> agricultural project district; <br /> (3) Any infrastructure requirements for the agricultural project district; and <br /> (4) Any open space requirements for the agricultural project district. " <br /> 15. SMA: The property is situated within the Special Management Area. Therefore, the <br /> proposed subdivision would be subject to review under the SMA requirements. <br /> -5- <br /> <br />
