Hawai‘i County Council-32 December 7, 2011 <br /> <br />Bill 134: INITIATES AN AMENDMENT TO THE HAWAI‘I COUNTY CHARTER (2010 <br />EDITION) BY ADDING A NEW ARTICLE RELATING TO MANDATORY DRUG <br />TESTING FOR ELECTED OFFICIALS AND AMENDING ARTICLE III, <br />SECTION 3-5, ARTICLE V, SECTION 5-1.6, AND ARTICLE IX, SECTION 9-6, <br />RELATING TO REMOVAL OF ELECTED OFFICIALS <br />Because elected officials (Council Members, Mayor, or Prosecuting Attorney) are <br />stewards of public trust, custodians of public finances, and persons who hold leadership <br />positions, they are subject to a higher standard of scrutiny and responsibility and they <br />should be subject to mandatory drug testing. The amendments relate to the following: Adds language <br />pertaining to the compelling interest standard, amends Sections 17-2 (Definitions), 17-3 <br />(Drug Testing), adds new section 17-4 (Notification of drug testing; voluntary agreement <br />by elected officials), and amends Section 17-5 (Refusals) and Section 8. <br /> <br /> <br /> <br /> <br /> <br />Bill 135: AMENDS CHAPTER 24, ARTICLE 10, DIVISION 5 OF THE HAWAI‘I COUNTY <br />CODE 1983 (2005 EDITION, AS AMENDED), RELATING TO PARKING <br />Amends Chapter 24, Article 10, Division 5, Section 24-280, Schedule 28 (No parking at <br />anytime), subsection (c), South Hilo, paragraph 86, to read as follows: <br />“(86) Kino‘ole Street, east (makai) side, from a point [four hundred thirty-one] ninety- <br />five feet [southeast] north (Hāmākua) of [Haili] Mamo Street [and extending one <br />hundred feet] to Mamo Street.” The purpose of the amendment is to increase parking in <br />the Downtown Hilo area. <br /> <br /> Re: Comm. 447 <br /> Intr. by: Mr. Blas <br /> Approve: PWPRC-59 <br /> <br /> Page 5 <br /> <br />
